These Terms of Use ("Terms") govern your access to and use of the public marketing website at up-stride.in (the "Site"), operated by UpStride by KeNi Solutions ("UpStride", "we", "us").
By accessing or using the Site, you agree to these Terms to the extent permitted by applicable law. If you do not agree with these Terms, please do not use the Site.
Important scope: These Terms apply only to the public marketing Site. They are not a software-as-a-service agreement, early-access agreement, or clinic services contract for the UpStride product application. Use of the UpStride product, including any early-access programme, is governed by separate terms presented at the time of access, where applicable.

2. What the Site is and is not
The Site provides public information about UpStride and ways to contact us, including for demonstrations, early-access interest and general enquiries.
The Site:
- does not provide access to clinic accounts;
- does not store or process therapy session notes, child clinical records or other clinical information; and
- is not a substitute for professional clinical, medical or therapeutic advice.
Information presented on the Site is provided for general informational purposes and should not be relied upon as professional clinical guidance.
Please do not submit patient, child-identifying, medical or other sensitive health information through Site forms. See our Privacy Policy (/privacy) and Security (/security) pages for more information.
3. Contact and demo enquiries
If you submit a contact or demo form on the Site, your submission is processed through Web3Forms and delivered to hello@up-stride.in, as described in our Privacy Policy.
Submitting a form:
- does not create an obligation for us to provide a demonstration, early access or any product or service;
- does not create a paid or unpaid subscription;
- does not grant you a licence to use the UpStride product; and
- does not guarantee acceptance into any early-access programme.
Any follow-up we offer is at our discretion unless we agree otherwise in a separate written agreement.
4. Acceptable use
You agree not to:
- use the Site in any way that is unlawful or infringes the rights of others;
- attempt to gain unauthorised access to the Site, our systems or information belonging to other users;
- interfere with or disrupt the Site, including through abusive automated traffic;
- use automated means to scrape, harvest or systematically extract Site content or contact information, except where permitted by law or with our prior written consent;
- submit false, misleading or abusive content through Site forms; or
- submit passwords, patient information or child-identifying information through Site forms or security reports, except where limited information is necessary to describe a security issue without exposing such information.
We may suspend or restrict access to the Site where we reasonably believe these Terms have been breached or where necessary to protect the Site, our users or our systems.
5. Intellectual property
The Site and its content, including text, graphics, logos, images, software, design and layout, are owned by UpStride or its licensors and are protected by applicable intellectual property laws.
You may view, access and share public pages of the Site for ordinary informational purposes. You may not copy, modify, reproduce, distribute, sell or create derivative works from Site content for commercial purposes without our prior written consent, except where permitted by law.
"UpStride" and related marks are used to identify our brand. Nothing in these Terms grants you a licence to use our trademarks or other intellectual property except as reasonably necessary to refer to UpStride factually.
Third-party trademarks and materials remain the property of their respective owners.
6. Third-party services and links
The Site may use third-party services, including hosting, form delivery and analytics services, and may contain links to third-party websites.
Third-party services and websites are subject to their own terms and privacy practices. We are not responsible for third-party content, services or practices outside our reasonable control.

7. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE FULLEST EXTENT PERMITTED BY LAW.
To the fullest extent permitted by applicable law, we disclaim warranties relating to the Site, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Without limiting the above:
- information about UpStride and its products or services is provided for general information and may change;
- we do not warrant that the Site will always be available, uninterrupted or error-free;
- we do not warrant that the Site will be free from harmful components, although we take reasonable measures to operate and secure it;
- we do not provide clinical, medical or therapeutic advice through the Site; and
- we do not guarantee any clinical, developmental or business outcome from information presented on the Site or from any product or service described on the Site.
Nothing on the Site constitutes an offer to sell software or services unless and until we expressly agree to provide those services under a separate written agreement.
8. Limitation of liability
To the fullest extent permitted by applicable law, UpStride and its officers, employees and agents will not be liable for indirect, incidental, special, consequential or punitive losses arising from or relating to your use of, or inability to use, the Site.
This includes, to the extent permitted by law, loss of profits, revenue, goodwill, business opportunity or data.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
9. Privacy and security
Our collection and use of personal information through the Site is described in our Privacy Policy (/privacy).
Information about how we protect and operate the marketing Site is described on our Security (/security) page.
Security concerns may be reported to security@up-stride.in as described on the Security page.
Please do not include passwords, patient information or other sensitive information when reporting a security issue.
10. Changes to these Terms
We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date on this page.
Continued use of the Site after updated Terms are posted constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
We may also modify, suspend or discontinue the Site or any part of it at any time.
11. Governing law and disputes
These Terms are governed by the laws of India.
Subject to applicable law and any jurisdiction that cannot lawfully be excluded, courts having jurisdiction in Hyderabad, Telangana, India will have jurisdiction over disputes arising out of or relating to these Terms or the Site.
Nothing in these Terms is intended to exclude or restrict any mandatory consumer protection or other statutory rights that cannot lawfully be excluded or restricted.
12. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
These Terms constitute the agreement between you and us regarding your use of the Site and supersede prior understandings relating to that subject only. They do not supersede separate product, commercial or other written agreements.
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a reorganisation, merger, acquisition or sale of assets.
